How Leaving a Legacy in Your Will Works

Your Frequently Asked Questions - Answered

Can you explain the jargon?

Your estate is everything that you own, including your house, money and any life insurance policies that will be paid on your death.

A Specific legacy is the gift of a specific item or asset such as shares or jewellery.

A Pecuniary legacy is a fixed sum of money. It is worth bearing in mind that inflation can reduce the value of pecuniary legacies over time, so it is worth reviewing your Will on a regular basis, whether or not your circumstances change.

A Residuary legacy is a gift of all or part of your net estate (what remains after all taxes, specific gifts and the cost of administering the estate have been paid). This type of legacy should be expressed as a percentage or share of your estate.

Executors are the people chosen by you to carry out the instructions contained in your Will.

Can I decide where my gift is spent or what it is used for?

Whilst general donations enable us to use funds where they are most needed at the time, we would be very pleased to allocate your gift for a specific purpose or project should you wish. Where this is the case, barnes Common Limited (BCL) would be more than happy to provide a report on progress as to how funds have been used and what impact they may have had.

How will you ensure my privacy?

We will always respect your privacy, handling your request with sensitivity and respect. It is your decision whether to tell us about your potential gift. As such, we will hold any information you give us securely.

Do I need to re-write my will?

It is easy to leave a gift and you don’t have to re-write your will. We highly recommend that you use a qualified solicitor to make a new will or to amend an existing will. You can find a solicitor in your local area using the Law Society’s website.

Can I change my mind?

We understand that your circumstances may change, or you might change your mind and you may need to take Barnes Common Limited out of your will. We will respect your decision.

What are the tax advantages of leaving money to charity?

Legacies to registered charities can be exempt from inheritance tax, while inheritance tax may be reduced from 40% to 36% on some assets if you leave 10% or more of the ‘net value’ to charity in your will. We recommend you look at the government’s guide to inheritance tax at https://www.gov.uk/inheritance-tax for the exact details.

Barnes Common Limited (BCL) does not provide financial advice hence we strongly recommend consulting a financial adviser about your individual circumstances.
